Terms of Service

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to use Spaces. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

You are responsible for the activity that happens under your account, for keeping your credentials confidential, and for promptly notifying us of any unauthorized use. We may suspend or terminate accounts that violate these Terms, the Community Guidelines, or applicable law.

You retain ownership of the photos, videos, music selections, profile text, guestbook entries, messages, and other content you submit ("Your Content"). By submitting Your Content you grant Spaces a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g. resize), display, and distribute it solely to operate, provide, and improve the Service and as you direct through your privacy settings.

You represent that you have the rights necessary to grant this license and that Your Content does not infringe any third party's rights or violate any law.

"Music selections" on your Space are short user-uploaded audio files or third-party preview links you choose to feature. You are responsible for ensuring you have the necessary rights for any audio you upload. We respond to valid takedown notices and may remove music we believe infringes copyright.

You agree not to:

• Violate the Community Guidelines.
• Use the Service to harass, threaten, defraud, or harm others.
• Post content that is unlawful, infringing, hateful, sexually exploitative of minors, or that incites violence.
• Send unsolicited friend requests, spam guestbooks/messages, or operate fake or impersonation accounts.
• Attempt to scrape, reverse engineer, overload, or otherwise interfere with the Service or its security.
• Use the Service to develop a competing product, or to train machine learning models on other users' content without permission.

Spaces facilitates friend requests, direct messaging, guestbook posts, and push notifications. You acknowledge that other users may contact you according to your privacy settings, and that we may send push notifications to devices on which you have enabled them.

If you believe content on Spaces infringes your copyright, send a notice including (a) your physical or electronic signature, (b) identification of the work, (c) the location of the material on Spaces, (d) your contact information, (e) a good-faith statement, and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act. Send notices to copyright@spaces.app.

You may delete your account at any time. We may suspend or terminate your access if we believe you have violated these Terms, the Community Guidelines, or applicable law, or to protect the Service or its users. Sections that by their nature should survive will survive termination.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the fullest extent permitted by law, Spaces and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of USD $100 or the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Spaces and its affiliates from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

We may update these Terms. We will provide notice of material changes. Your continued use of the Service after the changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, unless a different forum is required by applicable consumer law.
